About Us
Delaware Elder Law Center’s focus is on protecting a client’s assets from the devastating cost of long-term care so that they can afford the help that they need. The asset protection plan provides for the transfer of assets to intended loved ones upon death. We make it so that a trusted person has the legal authority to make financial and healthcare decisions for that person if they become disabled.
The legal services we provide are: individual and married couple applications for Long Term Care Medicaid, protection of assets and income, and estate planning documentation: will, trusts (revocable, irrevocable, special needs, and Miller trust), durable power of attorney, advanced healthcare directive, and HIPAA release. The benefit to the client is that they can afford the care that they need without going broke, the necessity of a guardianship is avoided, and there may be assets left over for their children to inherit. Many of our clients describe these benefits as “peace of mind”.
We work with families who are at one of the most vulnerable times of their lives. Our process is supportive and designed to get the family to the next step securely and safely. It is the client’s positive experience and peace of mind that matters above all else. To this end, we meet with the patient in their home, in the hospital, or in a facility when necessary so that their needs are met. Our attorneys and legal staff are available and responsive to clients and their family members. We refer clients to other elder care service providers to meet whatever non-legal needs they may have.
